I ask you all this, “Was the Indian Constitution made only
for studying in schools?” I ask this because from what I am seeing in
newspapers and on the news channels, I feel the answer is ‘yes’.
Our Indian Constitution gives us six fundamental
rights.
1.
The Right of Equality (Art. 14-18)
2.
The Right of Freedom (Art. 19-22)
3.
The Right against Exploitation (Art.
23-24)
4.
The Right to Freedom of Religion (Art.
25-28)
5.
Cultural and Educational Rights (Art.
29-30)
6.
Right to Constitutional Remedies(Art. 32)
Now, do we actually practice these? No, we don’t.
Right of Equality
Apparently, according to this right we cannot discriminate
on the grounds of religion, caste, creed, sex, place of birth, etc. But why
then, despite these rights given to us, did I see Rohith Vemula(a Dalit) dead? Why
then did I see Tabrez Ansari mob lynched and forced to say ‘jai shree ram’ and ‘jai
hanuman’? Why then did I see Mohammad Akhlaq killed because he was ‘suspected’
of eating beef? And even if he was, how can one change someone’s eating
habits? Can you tell Bengalis not to eat fish? (No offence to any Bengali)
Right of Freedom
I can express what I feel, through my writing or verbally. I
can assemble and protest peacefully if I want to. I can move in the country
freely. I don’t say it. My constitution gives me these rights. But if these rights were ‘really’ in
practice, Gauri Lankesh would have been here with us today. She would have not
been shot dead for what she wrote. That was her ‘right to freedom of speech and
expression’, but we couldn’t give it to her. Not always, but many times, when I
assemble for a protest, the police officers use their ‘lathis’ on us as we are
doing something unconstitutional or maybe going against the government. But sir/ma’am,
I thought I had the freedom of assembly?
Right against Exploitation
Human beings, children and women specially, cannot be
exploited, sexually or mentally. Human trafficking is prohibited. Dowry is
prohibited. The NCRB reported 11,212 of the victims were exploited in forced labour,
7,570 exploited in sex trafficking, 3,824 exploited in an unspecified manner,
and 349 exploited in forced marriage, although it is unclear if the forced
marriage cases directly resulted in forced labour or sex trafficking. The
government identified 8,651 boys, 7,238 women, 5,532 girls, and 1,696 men as
trafficking victims. (Source US DEPARTMENT OF STATE)
Right to Freedom of Religion
We definitely have the right to practice any religion, but
when we do, we are beaten up and many a times killed too.
Cultural and Educational Rights and the Right to
Constitutional Remedies
Thankfully, there are atleast two rights which
I see being followed. But only I see that. Maybe there are loop holes. (Let me
know if any)

fundamental rights was all because of my Political Science teacher, Mrs. Ambili
